in an effort to get the death penalty. casey seigel is in texas with the details. a bizarre twist in the trial of nidal hasan. he is defending himself with 13 counts of murder and 31 counts of attempted murder following a shooting at fort hood in 2009. court in recess after hasan's stand by attorney takes issue with representing the army sigh kie twist becau -- psychiatrist wants the death penalty. >> this attorney is saying i am having a hard time doing that because my client waived the white flag. >> the decision to represent himself gives him the opportunity to question victims on the witness stand. there is concern that experience could retraumatize those that are in the shooting.

>> it is time to brew on this. a 13-year-old boy is brutally beaten by three teenagers while on a school bus in florida. they repeatedly kicked and punched the kid. the attack taking place because he told school officials at a dropout prevention program that one of the teens tried to sell him marijuana. he had a broken arm and black eyes. the video has been released. many are criticizing the bus driver for not stepping in as well as civil rights activists for not speaking out about this beating. the victim was white the three attackers were black. we want to know what you think.

kansas and missouri even arkansas. just in the past few days some of these areas have seen as much as a foot of rain. that has really saturated the ground. we are still talking more rain today, tomorrow and even the day after that. heavy rain and because you have already seen so much rain flood something a huge concern. not just flooding but isolated tornadoes large hail and damaging winds will be possible with some of these thunderstost. we have the risk in sections of texas. take a look at the radar. this is how much we think has fallen out here according to radar we are talking a foot of rainy specially around wanesville. parts of texas, oklahoma even louisiana looking at temperatures into the triple digits. 26 is the high in san antonio. high temperatures only in the 70s. feeling a little september like out there. especially during the early

in little lake harbor. new jersey.com also reporting that a ticket was sold in south brunswick again at a grocery store. we have two winners in new jersey two people who may have been passing through new jersey now going to be mega millionaires splitting that jackpot with the winner from n minnesota. they are all holding a tiny piece of paper worth hundreds of millions of dollars. the jackpot was 425 million because of the frenzy to become millionaires that grew to $448 million. it is the 4th largest in u.s. history, lottery history. it is not that far removed from when the woman in florida won the $590 million jackpot a few months ago. that was the largest in power ball history. media crews camped out at this acme supermarket which opens in about 20 minutes. maybe the winner will show up. i kind of think they are going to be making plans to meet with
